1. Acceptance of terms

  • By accessing the site, creating an account or purchasing any product, you declare that you have read, understood and accepted these Terms and Conditions, as well as our Privacy Policy.
  • If you do not agree with any of these terms, you must refrain from using the site and from purchasing our products.

2. Definitions

  • “Products” refers to the prompts, collections, packs, templates and other digital materials offered on the site.
  • “User” or “customer” refers to any person who accesses, registers or purchases products.
  • “Owner” refers to the exclusive owner of the rights to the site and the Products.

3. Intellectual property

  • All Products, their content, wording, structure, selection, organization, brand, design and associated materials are original works of human authorship and belong exclusively to Ing. Brayan Alex Apfata Limachi, author and rights holder.
  • "Go Prompts AI" is the trade name and brand under which Ing. Brayan Alex Apfata Limachi operates, offers and commercializes the Products. Any reference to Go Prompts AI shall be understood as referring to its owner.
  • The prompts offered are original literary works protected by applicable copyright laws, including Peruvian legislation (Legislative Decree No. 822), Decision 351 of the Andean Community and the Berne Convention. Under such legislation, the moral rights over the works are perpetual, inalienable and non-waivable and belong to their author.
  • This ownership equally extends to all content created and published by the Owner on its official channels and profiles (including, without limitation, videos, audio, scripts, images, texts and posts on YouTube and social media). Such content is an original work of Ing. Brayan Alex Apfata Limachi, and its reproduction, re-editing, re-uploading or unauthorized use outside the official platforms is prohibited and entitles the Owner to request its removal and pursue any applicable actions.
  • No term of use, purchase or access transfers ownership or copyright in the Products to the user; these remain at all times vested in Ing. Brayan Alex Apfata Limachi.
  • All rights not expressly granted in these terms are reserved.

4. License of use

  • The purchase of a Product grants the user a personal, limited, non-exclusive, non-transferable and revocable license to use the Product solely for the user's own personal or professional purposes.
  • This license is exclusively for the buyer's own use and may not be assigned, lent, transferred or shared with third parties.
  • The license is granted over the use of the Product; it does not in any case constitute a sale of the copyright or ownership thereof.

5. Restrictions and prohibited uses

  • It is strictly prohibited to resell, redistribute, sublicense, republish, assign or commercialize the Products, in whole or in part, by any means.
  • It is prohibited to copy, reproduce, disseminate or make the Products available to third parties, whether free of charge or for a fee.
  • It is prohibited to present the Products, or any derivative or modified version of them, as the user's or a third party's own creation.
  • It is prohibited to remove, alter or hide authorship notices, marks or ownership signals included in the Products.
  • It is prohibited to use the Products to create a competing service, catalog or repository.

6. Accounts and purchases

  • The user is responsible for keeping their access credentials confidential and for all activity carried out under their account.
  • Access to purchased Products is personal and individual. Sharing accounts or access is prohibited.
  • The Owner may record and retain purchase and access information for validation, security and protection of its rights.

7. Breach and remedies

  • Breach of these terms entitles the Owner to suspend or cancel the user's access, without the right to a refund, without prejudice to any applicable legal action.
  • The Owner reserves the right to pursue all available civil and criminal actions against unauthorized reproduction, distribution or use of the Products, as well as against any infringement of its copyright.
  • In order to protect its rights, the Owner may retain and submit as evidence the purchase, access and identity information of the infringing user before the competent authorities.

8. Limitation of liability

  • The Products are provided “as is”. The Owner does not guarantee specific results from their use.
  • To the maximum extent permitted by law, the Owner shall not be liable for indirect, incidental or consequential damages arising from the use or inability to use the Products.

9. Changes

  • The Owner may update these Terms and Conditions at any time. The version in force will be the one published on this page, indicating its update date.
  • Continued use of the site or the Products after an update implies acceptance of the modified terms.

10. Governing law and jurisdiction

  • Except where mandatory law provides otherwise, these terms are governed by and construed in accordance with the laws of the Republic of Peru, the Owner's principal place of business, regardless of the country from which you access or purchase the Products.
  • Notwithstanding the foregoing, the Owner may bring and pursue actions to protect and enforce its intellectual property rights, and to claim for the unauthorized use, reproduction or distribution of the Products, before the competent courts and authorities of any jurisdiction in the world —including, without limitation, the United States of America and the country of residence or domicile of the infringer— at its sole election.
  • If the law of your country of residence grants you mandatory consumer rights that cannot be limited by contract, nothing in these terms deprives you of such rights or of the ability to bring proceedings before the competent courts of your jurisdiction where the law so requires.
  • The choice of Peruvian law does not restrict the Owner's ability to invoke and benefit from the protection that the copyright laws of other countries and international treaties (including the Berne Convention) grant to its works.
